You Can't Make This Sh*T Up!

From Drudge today:


Was Dem presidential hopeful John Kerry seen this weekend waving a gun which would have been banned if legislation he co-sponsored became law?

Kerry co-sponsored S. 1431 last year (“The Assault Weapons Ban and Law Enforcement Protection Act of 2003) which would have banned a "semiautomatic shotgun that has a pistol grip.”

Kerry was presented with the gun during a Labor Day stop in Racine, West Virginia.

"I thank you for the gift, but I can't take it to the debate with me," Kerry told a cheering crowd as he held up the device.

Kerry's bill would ban millions of semi-automatics, including those with "pistol grips." [Section SEC. 2; (H) (ii)]

Opponents of the bill successfully argued how nearly all guns have "pistol grips," inluding millions of Browning Auto-5 shotguns produced since 1903.

Keep in mind - Kerry is doing this stuff to make you gun-owners feel comfortable about voting for him...

Did he take this opportunity to say, "Well, while I thank you for this gift, I cannot accept it, as I feel that weapons like this in the hands of private citizens are a clear and imminent danger to the Republic!"

No, instead he he tongue-in-cheek observed that he would note be able to take it with him to the debates, for what purpose we can only guess...

I can take the joke. I can even appreciate it.

But can you imagine the uproar if the only difference in the post was the substitution of the word "Bush" for "Kerry"?

This leopard ain't changing his spots. He's just painting over them.

*BTW - I don't really think this shotgun meets the criteria of the bill - unless we are changing the definition of 'pistol grip' from "separate grip that hangs down distinctly from the stock or receiver" to "anything other than a straight-grip stock."

Say Uncle elaborates on how the transfer could still ultimately be illegal if Kerry isn't careful.

Dave Kopel makes the point I was thinking about making, but wanted to research a bit further. My point was (and is) that the definition of pistol grip is vague enough in the bill to cover the shotgun Kerry has - if the ATFE-types chose to interpret it that way. Which they might not under a Republican admininstration, but just might under a Democrat administration.

The weapon he has does not have a pistol grip. However, the transfer may be illegal under current law unless he has the arm transferred through a dealer in his home state.

Don't look now, Kerry's campaign has replied to Drudge saying the Republicans are lying. ( Not that they are. Kerry's voting record speaks for itself. Heck, his throwing in behind Edwards on S Amendment 2619 on S1805 was a bigger bit of evidence for his contempt of sportsmen everywhere.

It also shows that the good Senator doesn't really understand what his bill actually does. It doesn't matter what he wants it to do - it matters how it's written and what the lawyers and bureaucrats can do with that.

As written - that bill *can* be interpreted to ban that shotgun.

As written in the bill,

`(42) PISTOL GRIP- The term `pistol grip' means a grip, a thumbhole stock, or any other characteristic that can function as a grip.'

The definition is so loose that it includes anything that has a grip of any type. It's a good thing this ban went down. We need to keep the pressure on our Reps & Sens.

The ban also covers any PISTOL which has a pistol grip (which is all of them I think) and a detachable magazine, which would only omit revolvers.
The law also specifically bans semiauto shotguns with five rounds or less in either an internal or external magazine.
Read the whole thing. The last sentance of the second paragraph removes the exemption of semi-automatic shotguns that cannot hold more than 5 rounds.
Make no mistake about it:
You would only be able to own revolvers, hand actuated reloading rifles and shotguns. The other rifles are effectively banned because the law is so broad and since there was at some time, some military rifle like just about every civilian rifle out there.
